Eviction Moratorium is still in effect

Housing providers struggle with unpaid bills and face foreclosure

The state-wide eviction moratorium and 2020 governor’s order permitting local governments to temporarily limit nonpayment evictions expired Sept. 20, 2022. The COVID state of emergency remains in effect.

The local eviction moratoria for both Oakland and Alameda County remain in effect.  A suit by the California Apartment Association against the Alameda County moratorium denied the landlords’ request for summary judgment and found the moratorium to be temporary and therefore allowable under state law.  https://www.courthousenews.com/bid-to-end-alameda-county-covid-eviction-ban-stumbles/

However, the moratorium has been going on for three years and has been extended numerous times, so it does not appear to be temporary in nature.

In a separate lawsuit against the San Francisco eviction moratorium, while the judge also held that the moratorium was allowable under state law, he stayed his decision as that case is being appealed to the U. S. Supreme Court.
